ABSTRACT

One problem which may arise is the plaintiff’s wish to ‘see justice done’, alternatively stated as being a wish for revenge, and possibly to see the defendant suffer. Whilst few will admit to this, the usual comment being ‘I’m not doing it for money but to make sure it never happens to anyone else’. Off the record, the truth is more revealing being translated as ‘I’ll ... the ... for everything I can ... get’. This motive needs to be dealt with and it is through the offices of the mediator that this is possible.
