VICARIOUS LIABILITY FOR OTHER TORTS COMMITTED

During industrial action, other torts may inevitably be committed, such as nuisance, trespass, defamation, etc. For these torts, the statutory scheme of vicarious liability does not apply. To determine whether the union itself could be liable for these torts committed by officials or members requires an examination of ordinary common law principles.
