ABSTRACT

Unlike the Italian system, which foundered so seriously on the need for the central state to create the regional structures outlined in the constitution, the Spanish Constitution defines the methods by which prospective regions themselves may move towards regional government. This ‘organic’ system of regionalism defines the methods by which territories may establish autonomías. The key to this structure is the Estatuto de Autonomía or statute of autonomy, which is granted to each autonomous community. The three methods by which the statute could be established were:

(a) The second transitional provision (Title XII, Spanish Constitution);

(b) Art 143;

(c) Art 151.
