ABSTRACT
Another interpretation of Clause 11(1)(i) of the Agreement is that the notice must be given to the MIB within seven days of the date a warned period or trial date is actually allocated by the court, rather than the date that the claimant receives the notification of that date. Again, as with the notice for filing of a defence in 7.1.2, the court should be telephoned every three days after filing an allocation or listing questionnaire to see whether a date has been allocated.15
