A great many people mistakenly believe that if a trade mark is not registered then it is not legally protected. This is not the case if the mark in question has been put to significant use in trade such that it has become well-known and has thus accrued a ‘reputation’ and ‘goodwill’. Such an unregistered trade mark will then be protected in Ireland by the law of passing off.
