ABSTRACT

One of the justifications for consumer law is that in most cases, the consumer is in a weaker position than the supplier of goods or services in consumer contracts, because the law of contract generally assumes that parties to a contract are in equally strong positions to negotiate the terms of the contract. In many situations where consumers are entering into contracts, such as normal retail arrangements, there is little or no negotiation of terms prior to contract.
