ABSTRACT

Much of the legislation discussed in this chapter focuses on the information to be given to consumers. In some cases, this is to ensure that consumers are not misled, for example, in the case of s 6 of the Consumer Information Act 1978. In other cases, the objective is to allow consumers to make an informed choice as to whether to enter into a contract or, in the case of unsolicited commercial communications, whether to read an email. In the case of data protection, where the implications for individuals of dissemination of their personal data can be extremely serious, the legislation focuses on the key issue of whether the individuals are aware that their personal data are being processed and imposes the burden of fairness on data controllers.
