ABSTRACT

Anumber of obligations are set out at s 52 (2), to which the EPA is subject in the performance of its functions, including the following:

• to keep itself informed of policies and objectives of public authorities whose functions are relevant to the EPA’s areas of activity;

• to have regard to the need for a high standard of environmental protection; • to have regard to the need to give effect to the ‘polluter pays’ principle, as

set out in Council Recommendation 75/436/EURATOM/ECSC/EEC (OJ L194, 25/7/1975, pp 1-4); and

• to ensure, in so far as is practicable, that a proper balance is achieved between the need to protect the environment (and the cost of such protection) and the need for infrastructural, economic and social progress and development.
