ABSTRACT

The main European legislation impacting on age discrimination is Council Directive 2000/78/EC of 27 November 2000 establishing a general framework for equal treatment in employment and occupation. In the Preamble to the Directive, the Council of the European Union states:

However, importantly, the Preamble also holds that ‘this Directive shall be without prejudice to national provisions laying down retirement ages’ (s 14).
