ABSTRACT

A warranty deed is a deed that possesses the warranty or guarantee of the seller that the deed given to a buyer is free and clear of all encumbrances except those that are revealed. It is the seller's guarantee that a buyer of the property is receiving the property without liens or encumbrances, such as leases, except those specifically noted in the deed. Such a warranty passes from the seller to the seller's heirs and assigns should a problem be discovered in the future.
