ABSTRACT

An arrest is the initial formal procedure in a criminal investigation; it occurs when an officer indicates by word or action that a person will be taken to the station or otherwise placed in custody. Every arrest must be based on probable cause, which requires knowledge of facts and circumstances that reasonably support a conclusion that a suspect committed a crime. There are specific rules for many kinds of searches that accompany arrests, and these include the need for warrants and restrictions on the use of force.
