Rivers are rarely, nowadays, used as a direct drinking water supply, and it is difficult to see the landowner valuing the water highly as the only obvious benefit of pure water is its clarity and lack of odour. Therefore, pursuing an action against a polluter is unlikely, as he may lose the case and has little to gain from winning it.
