ABSTRACT

The sections of the federal Food, Drug, and Cosmetic Act (FD&C Act) [1] that are relevant to regulating filth, decomposition, and extraneous matter are sections 402(a)(1), (a)(3), and (a)(4). Section 402(a)(1) states that a food is adulterated when it bears or contains any poisonous substance which may render it injurious to health. In the area of filth and extraneous matter, this section generally applies to direct hazards such as contamination by hard or sharp objects such as glass or metal that might cause injury.
