ABSTRACT

Analleged cartel case with a price-fixing scheme is being handled by the Business Competition Supervisory Commission (KPPU) in Indonesia. PT Yamaha Indonesia Motor Manufacturing (YIMM) and PT Astra Honda Motor (AHM) are suspected of regulating the sales price of 110–125 cc automatic scooters in 2013–2014. The court case was contested fierce because AHM and YIMM rejected the allegations, but after strong evidence goiven in the hearing and the Supreme Court Verdict Number 04 / KPPU-I / 2016, PT AHM and PT YIMM must comply with the law. The law that has been violated is Article 5 Paragraph 1 of Act Number 5 of 1999 concerning Prohibition of Monopolistic Practices and Unfair Business Competition. AHM and YIMM are suspected of carrying out cartels that can harm consumers. A request for cessation submitted by AHM and YIMM was rejected by the Supreme Court. Thus, the case that KPPU started in 2016 has been continuously in court until now, in 2019.
