ABSTRACT

Provisions of the constitution of the Republic of Indonesia have determined the term of office of the president or head of state as five years. Afterwards he or she can be re-elected in the same position, but only once. but this is a reproach for the President and Vice President to be re-elected in the next election contest. There is a concern that state facilities attached to the office might be used in preparation for re-election. The approach method used in this study is normative juridical with descriptive analytical research specifications to review legal reconstruction related to the governance of the President and Vice President for a period so that there is no longer the term incumbent and opposition in order to achieve honest and fair general elections.
