ABSTRACT

Foreign-flagged ships scuttling undertaken by coastal States such as Australia, Indonesia and Malaysia are special measures in order to reduce the foreign fish ships coming into their territorial waters, in addition to special measures aimed to prevent and provide protection against the environment at sea. Countries have the right to make related policies as scuttling efforts to prevent, reduce and control pollution of the marine environment which is caused due to an infringement by foreign ships in territorial waters. Article 194 of measures to prevent, reduce and control pollution of the marine environment related to UNCLOS 1982 in coastal States, this rule provides States must take all the necessary action in accordance with the Convention, both individually as well as collectively according to the need to prevent, reduce and control pollution of the marine environment caused by any source by using this way for the most practical ways on them and in accordance with their abilities, as long as these countries must seek to comply with their policies. This action was carried out by coastal States such as Australia, Indonesia and Malaysia in the course of law enforcement not only for third countries avoiding the decline of the quality of resources both from the population, the number of catches as well as the condition of the ecosystem that is the habitat of fish. This provision in accordance with the principle of sustainable development that the country responsible for the guarantee activity in their jurisdiction and control do not damage the environment of other States.
