ABSTRACT

The chapter acknowledges that there might be a need for a formal response where an allegation or a complaint of bullying or misconduct has been made, preferably anchoring the process in established local policies and procedures. The basic principles on which a fair investigation should be carried out are explored, including the need for confidentiality (but not anonymity) and the importance of due process and natural justice. The various stages of the investigation process are examined including how to gather and assess evidence, reaching a conclusion and writing a report. A variety of obstacles or barriers to a fair investigation are discussed, drawing attention to the need for impartiality and necessary investigation competences on the part of investigators.
