ABSTRACT

This chapter first looks at the recently adopted International Labour Organization Convention and Recommendation Concerning the Elimination of Violence and Harassment in the World of Work, discussing key issues for the prevention of bullying and harassment. Then, we address strengths and weaknesses of state legislation on work-related bullying and harassment, and its interface with occupational health and safety and anti-discrimination law. We discuss the importance of recognition of a specific right to a work environment free from bullying and harassment for all workers and evaluate the potential of different legislative frameworks to prevent bullying and harassment and to ensure recourse and remedy for targets.
