ABSTRACT

This paper mainly puts forward suggestions on the legal provisions and law enforcement process in order to achieve the purpose of strengthening the protection of citizens. Law of the People’s Republic of China on Administrative Penalties for Public Security stipulates the basis of punishment for acts violating public security administration by public security organs, but the main purpose of this law is not to grant certain powers to public security organs. The primary objective of the law is to protect the rights and interests of citizens, and the process of amending the law proves this. However, after communicating with law enforcement officials and some citizens, the author finds that there are some problems about the protection of citizens’ rights and interests in the application of the law. These problems are the excessive administrative discretion space, the hearing system is not perfect, the operability of some clauses is not strong, and the law enforcement personnel do not pay enough attention to the procedural provisions. In order to better protect the rights and interests of citizens, the author adopts the method of combining theory with practice and puts forward countermeasures.
