ABSTRACT

This study aims to determine the legal risk management of contracts that occurred during the COVID-19 pandemic period using the ISO 31022: 2020 framework and Islamic values. This paper uses a normative juridical method with literature review on secondary data in the form of primary and secondary legal materials. The study found that the study of contract legal risk management is still very limited, especially for contracts that were carried out or took place during the COVID-19 pandemic. The use of the newly ISO 31022: 2020 is still not a reference for parties and the study is still limited from the perspective of Islamic values. Given the fact that this pandemic is still happening and is uncertain, it is necessary to examine the extent to which the negative implications extend to ongoing or new contracts. This study recommends a design on legal risk management of contract that blends framework based on the ISO 31022: 2020 and Islamic values, to provide the best interests of the main objectives of contracts and long-term business relationships.
