ABSTRACT

Drugs in the context of Islamic law are a matter of ijtihâdî, because drugs are not directly mentioned about the prohibition either in the text of the Koran or al-Sunnah, at the time of the Prophet Muhammad was known only as khamr. Firm and fair sanctions must be carried out for drug traffickers, especially in Indonesia as a chain breaker of crime, Islamic Criminal Law may be a solution for a punishment. The purpose of this study is to determine the criminal sanctions for drug abuse offenders from the perspective of Islamic Criminal Law. The research methodology used is a qualitative research method through literature study, with the type of juridical normative research. The law on drugs is haram and also haram khamr, so one of the penal sanctions is the death penalty with a hierarchical approach because of the effects caused by drugs from all aspects.
