ABSTRACT

The researcher in this piece would try to understand the working of Rawls’s theory of justice in the present Indian reservation system as this notion has been used to support a variety of “affirmative acts,” including the fair distribution of assets and preferential treatment of minorities in America. Therefore, the researcher believes that it would be interesting to apply it to the present Indian Reservation system. The author further discusses provisions and policies regarding the concept of reservation in India. The role of the judiciary in interpreting and implementing Rawls’s theory is another aspect discussed in the paper. To understand the problems relating to Rawls’s theory and its implementation in India, a brief comparison of the theory and its application in other jurisdictions has also been discussed in detail.
