ABSTRACT

The path to a greater transparency in the management of public finances led to the adoption of the new Law no. 315/2016 Coll. on the register of public sector partners. This so-called anti-shell law introduces after 1st February 2017 a new register of public sector partners led by the Slovak Ministry of Justice. The register re-places the previous register of beneficial owners led by the Office of Public Procurement. The introduction of the register of public sector partners aims to define the legislative requirements for entities, with which it enters the state, resp. PSE’s into legal relations, resp. in which a third party takes any transactions, including the sale of property to the state. The register should reveal the ownership structure of the companies. The aim of this subscription is to highlight the new legislation and to introduce rules, which the new law implements into practice.
