ABSTRACT

Chapter 10, “Practical Methods to Reduce Litigation Costs,” addresses strategies to reduce litigation risks and costs pertaining to environmental litigation with proactive measures to identify and eliminate liability creating conduct. The authors make recommendations for litigation preventive measures, collaborative decision making, avoiding dire financial implications of litigation with careful planning, ways to minimize litigation expenses, and reducing litigation costs. It concludes with an analysis of what we have learned since the inception of environmental litigation in the modern era.
