ABSTRACT
This chapter deals with the land acquisition for public use under Fiji Law. Under the Law, the right of the State and authorized statutory bodies to acquire or use private land for public purpose is protected the statute upon payment of just compensation to the affected owners. Land is an important component of a healthy economy in the urban centers in Fiji. It regulates the performance of the development of any sector in the country. The Town Planning and Subdivision of Land acts provide the legal framework for the physical planning of land in the declared towns and cities of Fiji. The Constitution of Fiji provides for the protection of private property against arbitrary expropriation, and the laws give protection to individual property owners against the arbitrary forcible taking of land for public purposes. The Fiji Road Authority (FRA) also involves the Department of Fisheries to assess compensation if traditional fishing rights are affected.
