ABSTRACT

The Hazardous and Solid Waste Amendments of 1984 (HSWA), which reauthorized RCRA, expanded the scope of the RCRA regulatory program to include certain previously unregulated underground storage tanks. Subtitle I of RCRA, as amended, gave EPA the statutory authority to regulate underground storage tanks (USTs) containing materials other than hazardous wastes. This action created an entirely new category of potentially regulated parties under RCRA, that of owners and operators of USTs containing petroleum (including used oils) and hazardous substances (other than hazardous wastes). Regulations for these underground storage tanks are codified at 40 CFR Part 280. Please note that underground and other storage tanks containing hazardous wastes had been regulated since the inception of the HWM program in 1980.
