ABSTRACT

The Fifth Amendment to the U.S. Constitution offers criminal defendants protections under five broad clauses. The first clause provides protection from being charged without an indictment or other charging instrument. The second clause deals with an issue known today as “double jeopardy.” The third clause deals with self-incrimination. The fourth and fifth protections, contained in the final clause of the amendment, deal with due process and the taking of property by the government.
