ABSTRACT
In an attempt to arrest the men, one of the ocers shot and killed one of the robbers. e survivor was taken into custody.
During the ensuing trial, one of the ocers took the stand and testied: “We were on surveillance at the store when two people came in to rob the store. ey pointed their guns at the store clerk and demanded money. My partner and I stepped out from behind the curtain, identied ourselves as police ocers, our badges were in plain sight on our belts, and told them they were under arrest and began to explain their rights. One of the men turned toward me with his gun and I, unfortunately, being afraid my life or my partner’s life was in imminent danger, I red and shot him. He died at the scene.”
