ABSTRACT

The survey by author shows that migrant workers having no consciousness of sports right is the first constraint (29.2%). This reflects the lack of consciousness of rights and interests of migrant workers. There are two constraints being tied for second. One of the two is that the company system doesn’t involve sports right of workers. This reflects the union being disadvantaged in the company in China. Another constraint is that the superior leaders don’t require lower organizations to provide sports service. The third constraint (16.7%) is that the Labor law and the Trade Union law of PRC do not have relevant clause about the protection of sports rights. Meanwhile, the Sports law has no direct legal binding effect to enterprises (see Table 1).
