ABSTRACT

Labor contract indicates that enterprise personnel in China begin to deal with employment relationship rationally, thus ensuring legal rights of enterprise personnel to a great extent. In the past, there was a hidden contract relation between employers and employees in China, and the occurrence and popularization of labor contract system disintegrated the relation. However, there is still some hidden relation between employers and employees, because of traditional ideas and backward legal system in China. So, informal labor relations are common in society, reflected in low ratio of labor contract signing between employers and employees. The employers are in a strong state, and the employees in a weak state, thus causing that the legal rights of employees are infringed by employers [1]. The unstable relation between employers and employees results in a series of social and economic problems. Consequently, the necessary condition and effectiveness of labor contract signing for enterprise personnel are researched in the work.
