ABSTRACT

This chapter examines critical legal impediments to City action with regard to climate change adaptation or climate change mitigation. 1 It engages with a number of city aspirations surrounding climate change and locates them within a legal and institutional context so that a view may be offered on the legal difficulties encountered. The aim of the chapter is to assist the City, where possible, with creative, yet legally incombustible arguments and to highlight, where needed, areas for legal reform. The chapter broadly deals with three themes: the legal impediments surrounding partnerships, the lack of clarity surrounding the constitutional mandate for climate change action and, finally, the opportunities for green procurement.
