ABSTRACT

The role of intellectual property rights (IPRs) in technology transfer (TT) in the context of climate change has been a controversial one. While some state that IPRs do constitute a barrier, it is argued by others that IPRs are not a barrier and are needed for incentivizing innovation.While a case-by-case approach has been suggested by some, solutions that use the patent system to develop commons and other similar arrangements for sharing technology have also been suggested.Patents are the most preferred options for intellectual property (IP) protection when it comes to technologies; hence, a focus on patents is inevitable. There is thus a wide variety of views in this issue and the debate is nuanced despite extreme positions. 1
