ABSTRACT

However, some outcomes are worth noting. In both instances, parents expressed the view that the process had been helpful and they had valued the opportunity mediation gave them to be heard. There was unanimity from those who took part in the process, whether as comediator, parent, parent advocate or LEA officer, that the process was of real value. Both the mediations carried out resulted in positive outcomes for both the parent and the LEA. Neither case went on to the SEN tribunal. In one instance a direct result of the mediation session was that a tribunal appeal was withdrawn and a satisfactory outcome was achieved. The mediation process gave the impetus to find a creative solution, involving another agency (social services). This not only resulted in the avoidance of a tribunal, but also gave a resolution, which satisfied both parties (such a solution would have been outside of the remit of the tribunal). It also served to strengthen joint-agency working.
