ABSTRACT
Private enterprises have been playing their important role in the Chinese economy in a very uncertain legal environment. The legal system does not provide timely and effective protection for private firms. Most legislation simply recognises current practice, and conflicts have arisen between the various laws and regulations that apply to private businesses. This chapter analyses the problems that China’s legal framework has created for the private sector, and looks at some of the recent legislation that has attempted to find solutions.
