ABSTRACT

The chapter explores the socioeconomic institutional reforms and promotion of transitional justice in societies emerging from post-conflict situations like Kosovo. It should be noted that corporations are the main beneficiaries of this combination of the investor-friendly institutional framework and privatization policies, as well as weak enforcement of environmental justice mechanisms in transitional societies like Kosovo. They provide not only for the direct application of provisions from the European Convention on Human Rights but additionally for their application as interpreted by European Court of Human Rights jurisprudence. EULEX's role in efforts aimed at restoring the rule of law arguably means that the European Union (EU) is the most significant international organization and World Bank Group membership is of immense value as a catalyst for economic reconstruction efforts within Kosovo. First, privatization 'has become the economic strategy of choice for international state-building projects. Second, the arguably unique character of the socialist model of Yugoslav political economy should be acknowledged.
