We have provided no short way to a decision on, say, capital punishment as a penalty for murder; we have only indicated the lines on which discussion must go. But if, as some maintain, to abolish it would not impair the effective deterrence or prevention of that crime, there would seem, on our analysis, no further argument by which to defend it.22
