ABSTRACT

This chapter looks at some of the specific wordings and guidance associated with the issue of maritime security. The shipping industry is currently facing a period of significant challenge on all fronts. Economically, the markets are difficult and remain depressed with a number of high profile casualties, most recently Hanjin. The Charterer essentially obtains the right to direct for the period of the charter what cargoes the vessel should carry and between what ports. Baltic and International Maritime Council (BIMCO), in conjunction with a number of other international maritime organisations, has recently released their 'Guidelines on Cyber Security on Board Ships'. Increasingly, however, the risks associated with maritime security are the subject of special clauses within charters. War clauses are, of course, well-known but international organisations such as BIMCO now offer a range of standard clauses dealing with other security issues.
