ABSTRACT
The chapter offers some very interesting thoughts of the interface between development, modernisation and tradition, and the fallacious understanding of tribal communities as homogenous entities, pointing to their fragmentary nature in the modern age. The author also draws our attention to the often over-looked similarities between customary and common law.
