ABSTRACT

This chapter discusses on overview of the legal basis of EU-Belarus relations. The analysis builds upon that basis in defining the aspects of international and EU law presence in Belarus and the ways it is approached within the national constitutional framework. Legislative approximation elements in the law-drafting process in Belarus are explained. This includes the institutional mechanism of law-making and law-drafting itself, which are then complemented by exploring the presence of EU law in different fields of national legislation. An attempt is made to juxtapose international and EU law with the Belarusian judiciary. Finally, and increasingly important, the issues of Eurasian integration of Belarus are addressed. In conclusion, back-door approximation is structured and possibilities for future development are envisaged. The technical dialogue with the EU, mainly via the European Neighbourhood and Partnership Instrument (ENPI), particularly TAIEX, has contributed to the process of legislative approximation as long as it also covers the development of the Belarusian legal system.
