ABSTRACT

The objective of this chapter is to scrutinize contemporary developments in the area of legislative approximation and application of EU law in Russia. It also focuses on the legal foundations of the EU-Russia Strategic Partnership. The chapter focuses on the role of international law, including the status of the EU-Russia PCA within the Russian legal order. It also offer examples of legislative approximation of Russian public and private law with EU law. The chapter discusses to what extent the Russian judiciary uses sources of EU law in domestic judgments and why it does so. The process of legislative approximation of Russian law with EU law went beyond the scope of the approximation clause in the EU-Russia PCA. This process was exercised in line with priority areas of the legal reform in Russia and thereby reflected the pragmatic approach of the Russian government towards the modernisation of the Russian legal system.
