ABSTRACT
IN his classic work on the “judicial mind,” Schubert (1965) found that ideologies and attitudes of justices of the Supreme Court of the United States accounted for a significant amount of their voting behavior. His sophisticated model of judicial behavior confirmed the a priori, albeit then inconoclastic, conclusion about the relationship between the Constitution and the Court held by Chief Justice Charles Evans Hughes: The Constitution, quite simply, is what judges say it is.
