ABSTRACT

The Constitutional Court of Korea has just celebrated its 20th anniversary, a significant milestone. Of the five designated constitutional courts in East and Southeast Asia (the others being found in Indonesia, Taiwan, Thailand and Mongolia), it is arguably the most important and influential, and therefore deserves close scrutiny as a case-study in judicialization of constitutional politics in Asia. This chapter examines some of the leading decisions of the Constitutional Court in light of the issues raised in this book.
