ABSTRACT

The Community shall be a hub of multilayered regimes in the region and shall contribute to global governance. The constellation of authority reflects the essential character of the Community as an intergovernmental one. For fostering the peoples' awareness of and support for the activities of the Community, the Draft Charter assigns many significant roles to the non-governmental institutions compared to the constitutional treaties of other regional organizations such as the ASEAN Charter and the Charter of Shanghai Cooperation Organization. The Secretary-General or a designated representative is entitled to attend the meetings of the Council of Ministers without voting rights. As in the East Asian Council, the Council of Ministers is best characterized as a 'quasi-hybrid' institution. The East Asian Council and the Council of Ministers are essentially intergovernmental institutions, whereas the East Asian Secretariat, the Eminent Persons Committee and the National Parliamentarians Committee are non-governmental institutions whose members are independent of the instructions of the government of any Member State.
