ABSTRACT

Art. 185. (1) In the absence of particular circumstances or agreements constituting an exception, benefit and risk of the goods pass to the buyer with the conclusion of the contract. (2) If the sold goods have only been specified by their kind, the goods must have been separated and, if they are meant to be forwarded, have been turned over for dispatch. (3) In a contract subject to a condition precedent, benefit and risk of the sold goods do not pass to the buyer until the occurrence of the condition.
