ABSTRACT

Arts 85 to 88 CISG are compiled in a separate Section dealing with the preservation of goods. The duty to preserve the goods may arise if the buyer rejects them or does not take them over. Since, under those circumstances, it will often be unclear whether there is a breach of contract on behalf of one of the parties, the purpose of this Section is to prevent a deterioration of the goods by imposing on either the seller or the buyer the duty to preserve and store the goods until the legal situation has been clarified.
