The state under the rule of Law

The concept of the ‘state under the rule of Law’ ¹ originated in nineteenth-century German jurisprudence (philosophy of law), where it was developed as part of the broader ‘doctrine of the state’. ² Thanks to its prestige in Germany, the doctrine of the state spread to all European countries except Britain, which has retained its own distinct notion of ‘government’.
