Reform of the New Zealand Land Transfer Act

This chapter traces in detail the process undertaken by the New Zealand Law Commission to develop a modernised Land Transfer Act incorporating the advances in digitalisation of titles and land data, and automated conveyancing. The author outlines the main features of the new Land Transfer Act 2017 and the justification for the many changes, including the judicial discretion to override indefeasible title in cases of ‘manifest injustice’.
