ABSTRACT

The question of unwritten international law is one of the more comprehensive issues concerning the sources of international law and the discussion is wide ranging and continuing. The development of the international community requires scholars to maintain a constant review and analysis of the sources of international law. The specific rules of unwritten law are for the most part concerned with rights and duties of the subjects of international law which have been developed through the customary international law. The progressive recognition of human rights guaranteed by international law also conflicts with state sovereignty and the rule of domestic jurisdiction. The protection of human rights by international law has been welcomed in principle on every side but it involves the risk of unlawful intervention in matters of domestic jurisdiction as well as the danger of double standards where ideologies conflict.
