ABSTRACT

This chapter deals with the legal aspects of current antisemitism, focusing on two issues: first, on the legal effects of current antisemitism; and second, on the possibilities of legal action to fight it. It also deals with some basic questions relating to the justification of this fight by law. The most prevalent form of antisemitism today is antisemitic pro-paganda. Two points of principle should be considered in connection with the entire complex of the legal fight against anti-Semitism. First, is it justified, for the sake of fighting antisemitism, to advocate legal measures that would amount to the restriction of some basic rights and freedoms, like the freedom of expression, thought, association, or assembly? The second threshold question is this: Can the legal fight actually be effective against a disease that has deep-rooted national, racial, social, and psychological causes? Is not the cure to be sought more in education and enlightenment?.
