ABSTRACT

This chapter deals with mediation as a conflict resolution technique. It looks at the reasons why and the circumstances in which mediation has been successful, and those where it has been a failure. The chapter outlines the number of case studies, from a pragmatic standpoint, with the aim being to draw a number of general conclusions, suggesting when and how mediation might be used to solve future conflicts. It provides some final points concerning the major features specific to mediation, as a means of dispute settlement. The final treaty between Iran and the US provided for the setting up of a mechanism for the settlement of future disputes that might arise from the implementation of the agreement. The advantage of mediation is that it can apply to any kind of conflict, be it a purely legal dispute or a combination of legal, political, ideological or economic factors.
